GENERAL TERMS AND CONDITIONS ONLINE SHOP WE ARE ZRCL
These General Terms and Conditions (hereinafter GTC) of WE ARE ZRCL GmbH (hereinafter ZRCL) as seller and you as customer apply to all orders in the WE ARE ZRCL online shop (www.wearezrcl.com) as well as to those purchases for which WE ARE ZRCL declares these GTC to be applicable.

Scope of application
The GTC apply to all services provided by WE ARE ZRCL in the online shop (www.wearezrcl.com) and become valid upon conclusion of a contract. The deliveries, services and offers of WE ARE ZRCL are made exclusively on the basis of these GTC, even if they are not expressly agreed again. By sending an order to WE ARE ZRCL, you confirm that you have read these GTC and expressly declare your agreement with them.

Conclusion of a contract
All information on goods and prices within the ordering process is subject to change and non-binding. Purchase contracts are concluded when WE ARE ZRCL accepts your order. The acceptance of the order will be confirmed to you by WE ARE ZRCL via e-mail and is subsequently binding for you. You will also be informed of any obstacles to delivery as soon as possible by e-mail. By placing your order, you confirm that you are aware of the scope and content of your order. Delivery
You can choose to have your order dispatched to an address of your choice.
The delivery of the goods is always climate-neutral via the post office. The delivery time in Switzerland is 1-5 working days.
For deliveries abroad, the delivery time depends on the location of the recipient. Furthermore, additional taxes and customs duties are incurred at the border, which are generally to be borne by you.
If, in exceptional cases, an item in the range is not available, we will inform you as soon as possible by e-mail. In principle, WE ARE ZRCL reserves the right to make a partial delivery if this appears to be conducive to the efficient processing of the overall delivery. In such cases, no additional shipping costs will be charged for the subsequent delivery.

Prices
All prices on www.wearezrcl.com include the statutory value added tax in Switzerland (currently 8.1%) and exclude shipping costs. The actual shipping costs are displayed in the shopping basket before the order is completed. WE ARE ZRCL has the right to adjust the prices shown online at any time without prior notice and without further explanation. Prices are calculated at the time the order is placed on the website.

Shipping costs
In Switzerland, shipping is free for orders over CHF 100. If the order value is less than CHF 100, a shipping fee of CHF 10 will be charged.
In the EU, shipping is free for orders over CHF 150. If the order value is less than CHF 150, a shipping fee of CHF 15 will be charged.

Terms of payment
The following payment options are available to you:
Purchase on account, credit cards (Visa, Mastercard, Diners Club/Discover, American Express), Paypal or prepayment by bank transfer.
The payment period for advance payment by bank transfer is 10 days. If payment is not received within this period, WE ARE ZRCL reserves the right to cancel the order and release the goods for sale again. Any transfer fees are to be borne by you.
All card payments are processed via the secure payment server of Paypal (www.paypal.com) and Stripe (www.stripe.com). WE ARE ZRCL does not store any credit card details itself.

Retention of title; offsetting; right of retention
(1) In the case of consumers, we reserve title to the purchased item until the invoice amount has been paid in full. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve title to the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
(2) You shall only have a right of set-off if your counterclaims have been legally established or are undisputed or recognised by us. In addition, you only have a right of retention if and insofar as your counterclaim is based on the same contractual relationship.
(3) If you are in arrears with any payment obligations to us, all existing claims shall become due immediately.

Right of cancellation
You may cancel the contract and return or exchange the goods within 14 days (postmark) of receipt of the goods without giving reasons. The deadline of 14 days is met if you declare the cancellation in writing or by e-mail and return the goods with the completed returns form to:

When returning goods, please keep the parcel posting receipt.
WE ARE ZRCL will not pay the postage for the return. Returned items will only be accepted in unworn/unused condition and in their original packaging. Transport damage must be reported to the post office within 5 days. WE ARE ZRCL will refund the value of the goods only after receipt of the goods returned in the condition described.

Guarantee and warranty
The guarantee or warranty for goods corresponds to generally accepted standards and is 24 months, unless a longer guarantee period is expressly stated on the delivered goods. Defective goods must be reported in writing to the above address immediately within 10 days of delivery or after the damage has occurred, otherwise the warranty claim will be cancelled. The warranty claim is valid from the date of delivery. It shall lapse in the event of improper use or natural wear and tear. WE ARE ZRCL reserves the right to make individual decisions in the event of a warranty claim.

Minor model deviations
It may happen that the design of individual items changes slightly. WE ARE ZRCL cannot accept any liability for such modifications. However, you can exchange such items within 14 days if you wish, as explained above under the heading Right of cancellation.

Care/handling
WE ARE ZRCL accepts no liability for the customer's misbehaviour in the care and/or handling of the items supplied. We therefore ask you to observe the corresponding instructions on the goods.

Data protection
WE ARE ZRCL undertakes to process your customer data carefully and to observe the provisions of the relevant data protection legislation. In particular, no data will be passed on to third parties. WE ARE ZRCL uses suitable security technology to protect customer data against unauthorised processing. However, no liability can be accepted for the security of data transmitted via the Internet. The transmission of data is encrypted. Detailed information on data protection can be found in our privacy policy.

General liability
It is hereby expressly pointed out that no liability claims can be made against WE ARE ZRCL for indirect damage or consequential damage suffered by the customer, unless WE ARE ZRCL has caused damage intentionally or through gross negligence.

Amendment of GTC
WE ARE ZRCL expressly reserves the right to unilaterally amend these GTC at any time without prior notice, in particular in the event of changes to the relevant legal provisions.
Applicable law/jurisdiction
In all cases, the relationship between you and WE ARE ZRCL shall be governed by Swiss law in accordance with the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB). The application of the provisions of the Vienna Sales Convention ("United Nations Convention on Contracts for the International Sale of Goods") is expressly excluded.
The place of jurisdiction is the legal domicile of WE ARE ZRCL GmbH, currently Rickenbach, unless the place of jurisdiction is governed by the Swiss Jurisdiction Act.
